NEGADA LA INSCRIPCIÓN DE HIJA DE MADRES LESBIANAS

 

ATENTADO A LOS DERECHOS DE LAS MUJERES LESBIANAS EN EL ECUADOR

 

El día martes 22 de Mayo del 2012 el Señor Juez Vicente Altamirano resuelve: INADMITIR la Acción de Protección planteada por la Defensoría del Pueblo a favor de Nicola Susan Rothon y Helen Louise Bicknell; “en razón a que el Acto Administrativo de la Dirección Nacional General del Registro Civil, Identificación y Cedulación, es susceptible de ser impugnado en la vía judicial, vía adecuada y eficaz, contenida en la Ley de la Jurisdicción Contencioso Administrativo”.

Esta Resolución niega la posibilidad de proteger los derechos de las compañeras lesbianas a favor de la construcción de su familia, en los términos que ellas consideran válidos.

Adicionalmente se convierte en una reiterada y sistemática discriminación, a causa de la orientación sexual de estas mujeres, cuya identidad sexual influye directamente en la posibilidad de acceder a los mecanismos de justicia eficaz y eficiente.

La niña Satya se encuentra en la indefensión total, ya que no puede inscribirse con los apellidos de sus Madres, razón por la cual no cuenta con la protección de sus derechos elementales, de identidad, de libertad, acceso a la salud y otros.

Quienes defendemos los derechos de la Población LGBTI consideramos que esta es una muestra de que la Iglesia continúa influyendo en las decisiones de un Estado “Laico” y Democrático, y que estas respuestas judiciales forman parte de la deuda del Estado Ecuatoriano (misógino y patriarcal) en la defensa de los derechos de la Población LGBTI en el Ecuador, creando categorizaciones discriminatorias dentro de sus pobladores.

NO SOMOS, NI SEREMOS CIUDADANAS NI CIUDADANOS DE SEGUNDA. PELEAREMOS EN TODAS LAS INSTANCIAS HASTA LOGRAR JUSTICIA PARA NUESTRA COMUNIDAD.

 

Por esta y otras razones convocamos a todos los medios de comunicación a la rueda de prensa que se llevará a cabo el día miércoles 23 de Mayo del 2012, en las Instalaciones de Causana (Av. Pérez Guerrero Oe375 y Versalles) A las 11h00.

DENIED ENTRY OF MOTHER DAUGHTER LESBIAN

ATTACK OF THE RIGHTS OF LESBIAN WOMEN IN ECUADOR

On Tuesday May 22, 2012 Mr. Justice Vicente Altamirano resolved: Dismiss the Protective Action raised by the Ombudsman for Nicola and Helen Louise Rothon Susan Bicknell, «due to the Administrative Act of the National General Civil Registry and Identification, is likely to be challenged in the courts, appropriate and effective way, contained in the Law of Administrative Jurisdiction. »

This resolution denies the possibility of protecting the rights of lesbian partners for building your family in terms that they consider valid.

Additionally becomes a repeated and systematic discrimination because of sexual orientation of these women, whose sexual identity directly influences the ability to access justice mechanisms effectively and efficiently.

Satya She is in complete helplessness, because you can not register with the surnames of their mothers, why not have the protection of their fundamental rights, identity, freedom, access to health and others.
