El género no se evidencia en la cédula

El colectivo GLBTI promueve una campaña para que se sustituya la palabra sexo por género en el documento de identidad.

Incomodidad al presentarse en un consultorio médico y estar en la lista de los hombres. Vergüenza de figurar en el registro masculino de la universidad. Cada vez que debe presentar su cédula para algún trámite, Diane Rodríguez, transexual guayaquileña, siente una mezcla de rabia y angustia. “No entiendo qué parte de mí no se ve femenina”, dice; pero recuerda que la letra M en su documento sigue contradiciéndose con lo que ella es.

Por eso y para que se respete su identidad de género ella impulsa la campaña Mi género en mi cédula. Rodríguez, presidenta de la agrupación Silueta X, presentó un proyecto de reformas a la Ley del Registro Civil, junto con tres asociaciones más que velan por los derechos de la comunidad trans del país: Confederación Ecuatoriana de Comunidades Trans e Intersex (Confetrans), Proyecto Transgénero y Construyendo Igualdad. Son cinco reformas a la ley pero la principal propone que se sustituya en la cédula la palabra sexo, por género.

El documento para reformar la Ley del Registro Civil fue presentado el 23 de julio ante la Comisión de Gobiernos Autónomos y Descentralizados. Elizabeth Vásquez, fundadora del Proyecto Transgénero, cuenta que hasta el momento ha tenido buena acogida por parte de los asambleístas de la Comisión y que el miércoles 12 de septiembre, de 10:00 a 12:00, se socializará el proyecto en un salón de la Asamblea. ¿Pero por qué este colectivo solicita este cambio? “Lo que mostramos las personas trans es nuestro género, nuestra masculinidad o feminidad, no mostramos nuestro sexo”, argumenta María José Guevara, transgénero mujer, en un video que circula en YouTube desde hace 3 meses y promueve esta campaña.

En la pieza audiovisual, que lleva el nombre de la campaña Mi género en mi cédula, Guevara y cuatro ciudadanos trans dan sus razones por las cuales piden esta modificación en el documento de identidad. En los cuatro minutos que dura el video, ellos narran experiencias y obstáculos a los que se enfrentan por contar con una cédula oficial que no concuerda con su identidad de género ni con su aspecto físico. “Porque la masculinidad que represento día a día es la que me identifica, es la que tengo el orgullo de ejercer todos los días. Y la que quiero que sea respetada bajo toda circunstancia”, expresa en el video, Gustavo, hombre trans. “¿Me ves algo femenino? Pues pienso que no lo tengo”, es otra frase que dice Mathías, un joven de cabello y barba negras que viste una camiseta celeste.

La propuesta de cambio de palabra -de sexo a género- en el documento tiene su origen en los conceptos de la pensadora contemporánea Judith Butler. La filósofa sostiene que el sexo es la parte natural y biológica y el género es lo que se construye social y culturalmente. Rodríguez comparte esa idea, cree que los órganos sexuales no construyen la identidad y que, en su caso, no se ha sometido a una intervención quirúrgica de cambio de sexo porque dice que ella no necesita la operación para sentirse femenina.

Vásquez, quien también es activista Glbti y abogada, explica que con esta propuesta se pretende que la ley del Registro Civil se actualice con la Constitución actual. El numeral 2 del artículo 11 de la misma especifica que “Nadie podrá ser discriminado por razones de identidad de (…) género…”. A pesar de que la Carta Magna es la única que contempla el concepto de identidad de género en el mundo, Vásquez dice que no se la ha aprovechado para garantizar otros derechos.

Actualmente si una persona trans quiere modificar su sexo de F a M o viceversa, debe presentar una demanda y seguir un proceso judicial sumamente largo. Si es que esta propuesta es aceptada y se modifica la categoría, de sexo a género, Ecuador se convertiría en el primer país en reconocer este tipo de identidad.

Trans y el mundo

En el mundo existen tres sistemas para cambiarse de sexo en el documento. El primero requiere una operación de sustitución de genitales. El segundo un examen de valoración psicológica. Y el tercero, que funciona en Argentina, permite el cambio de sexo en la cédula solo con el consentimiento de quien lo solicite. No se requieren exámenes de ningún tipo. Los procesos para modificar el sexo en la cédula se realizan por vía judicial -presentando una demanda y siguiendo un juicio- y por vía administrativa.

Gender was not evident in the ID Card

The proposed change of word-of-gender sex in the document comes from the concepts of contemporary thinker Judith Butler. The philosopher argues that sex is a natural and biological and gender is what is socially and culturally constructed. Rodriguez shares that idea, believes the sexual organs and identity building, if any, has not undergone a surgical sex change because she says she does not need surgery to feel feminine.

Vasquez, who is also GLBTI activist and lawyer, explains that this proposal is intended that the Civil Registry Law is updated with the current constitution. Paragraph 2 of Article 11 of the same states that «No one shall be discriminated against on grounds of identity (…) sex …». Although the Constitution is the only one that includes the concept of gender identity in the world, Vasquez said that it has not been exploited to guarantee other rights.

Currently if a person wants to change their sex trans F to M or vice versa, must file a claim and follow a very long trial. If this proposal is accepted and amending category, from sex to gender, Ecuador became the first country to recognize this type of identity.

Trans and the world

In the world there are three sex-change systems in the document. The first requires a replacement operation genitals. The second examination of psychological assessment. And the third, which operates in Argentina, allows sex change on the ballot only with the consent of solicitors. No tests are required whatsoever.
