Repudio a Declaraciones Trans-fóbica de Alfonso Luz Yúnez

La Asociación SiluetaX, rechaza categóricamente las declaraciones vertidas por el magistrado de la Corte Constitucionaly presidente electo del Colegio de Abogados del Guayas (CAG), Alfonso Luz Yúnez, en una carta abierta dirigida al secretario jurídico de la Presidencia, Alexis Mera publicada el 9 de diciembre del 2011 en el Diario Hoy: http://www.hoy.com.ec/noticias-ecuador/prepotente-llama-luz-yunez-a-mera-519887.html , por las siguientes razones:

Nuestra Comunidad, no comprende como un jurista utilizó la siguiente frase, la cual ha sido tomada del texto de las declaraciones:

“Es como un travesti de la política… que por unas cuantas monedas es capaz de las aberraciones”.

Cuando gozamos de una Constitución tan rica que cubre casi toda la pluriformidad de los Derechos Humanos, con especial énfasis que suscita este caso en poblaciones Trans (Travestis, Transgéneros y Transexuales):

Artículo #11 Inciso 2 – Principio de Aplicación de los Derechos: Nadie podrá ser discriminado… por Orientación Sexual…. por Identidad de Género…;

 Artículo #66 Inciso 3 – Derecho a La integridad física, psíquica, moral y sexual;

 Artículo #66 Inciso 5 – El derecho al libre desarrollo de la personalidad, sin más limitaciones que los derechos de los demás;

 Artículo #66 Inciso 9 – El derecho a tomar decisiones libres, informadas, voluntarias y responsables sobre su sexualidad, y su vida y orientación sexual.

En este sentido, las poblaciones Trans  (Travestis, Transgéneros y Transexuales)  estamos amparadas antela Constitucióndela Repúblicadel Ecuador, elegida democráticamente por los ecuatorianos, durante el año 2008.

Es necesario mencionar que las poblaciones Trans (Travestis, Transgéneros y Transexuales http://ai.eecs.umich.edu/people/conway/), no tenemos inherente el trabajo sexual y que de percibirse así, esto esta sujeto a factores de exclusión bio-psico-social en relación a la identidad de género de las personas.

Complementando lo dicho, el “intercambio de monedas” o mejor entendido en este caso, “el trabajo sexual” no minimiza a ningún ser humano, por el contrario es una forma de búsqueda, al tratar de sobrevivir en un sistema capitalista, consumista y egoísta ante la pobreza, falta de educación y otros factores sujetos a la temática en la que nos encontramos.

Adicional a esto la condición Trans (Travestis, Transgéneros y Transexuales), esta sujeta a factores multilaterales en la cual provocan un quiebre dentro de la Cis-Hetero-Normativa estándarizada en su grado de permisibilidad.  (http://www.shb-info.org/id1.html)

El utilizar la población Trans (Travestis, Transgéneros y Transexuales) para minimizar y cosificar a cualquier ser humano, sobre-entiende que no solo anula a las personas Trans (Travestis, Transgéneros y Transexuales), sino que nos convierte en esclavas perpetuas de un sistema que nos excluye de la dictonomía social; y por lo cual, nuestra Carta Magna intenta incluir.

Con estos antecedentes, solicitamos la manifestación de las Organizaciones de Derechos Humanos Nacionales e Internacionales, Autoridades del Estado, Sociedad Civil, Activistas Nacionales e Internacionales, etc. A repudiar esta clase de estigmatizaciones que afectan gravemente los Derechos Humanos de las personas Trans (Travestis, Transgéneros y transexuales), y que nos convierten en objeto lingüístico de un debate polémico, en el cual nuestra vulnerada comunidad no tiene que ver en absoluto.

Repudiation of Trans-phobic statements Luz Alfonso Yúnez

Silueta X Association categorically rejects statements made by the Constitutional Court judge and president-elect of the Bar Association of Guayas (CAG), Alfonso Yúnez Luz, in an open letter addressed to the legal secretary of the Presidency, Alexis Mera published December 9, 2011 in the Journal today: http://www.hoy.com.ec/noticias-ecuador/prepotente-llama-luz-yunez-a-mera-519887.html, for the following reasons:

Our Community, does not understand how a lawyer used the following phrase, which has been taken from the text of the statements:

«It’s like a transvestite politics … for a few coins that is capable of the aberrations. «

When we enjoy a rich Constitution that covers most of the pluriformity of Human Rights, with special emphasis raised by this case Trans people (transvestites, transgenders and transsexuals):

Item # 11 ITEM 2 – Application of the Principle of Rights: No person shall be discriminated against … Sexual Orientation …. … gender identity;

Item # 66 ITEM 3 – Right to physical, mental, moral and sexual

Item # 66 Item 5 – The right to free development of personality, no limitations other than the rights of others;

Item # 66 ITEM 9 – The right to make free, informed, voluntary and responsible about their sexuality, and his life and sexual orientation.

In this sense, the populations Trans (Transgender, Transgender and Transsexual) are covered before the Constitution of the Republic of Ecuador, the Ecuadorian democratically elected, in 2008.

It should be mentioned that Trans people (transvestites, transgenders and transsexuals http://ai.eecs.umich.edu/people/conway/), we have no inherent sex work and perceived that way, this is subject to exclusion factors bio-psycho-social in relation to gender identity of people.

Complementing the above, the «currency exchange» or better understood in this case, «sex work» does not minimize any human being, on the contrary is a search, trying to survive in a capitalist, consumerist and selfish to poverty, lack of education and other factors subject to the subject in which we live.

In addition to this the condition Trans (Transgender, Transgender and Transsexual), is subject to multilateral factors which cause a break in the cis-hetero-normative standard in their degree of permissibility. (http://www.shb-info.org/id1.html)

Using Trans people (transvestites, transgenders and transsexuals) to minimize and objectify any human being over-understood that not only cancels Trans people (transvestites, transgenders and transsexuals), but that makes us a perpetual slaves we excluded from social dictonomía, and therefore, our Constitution intended to include.

With this background, we request the manifestation of the National Human Rights Organizations and International State Authorities, Civil Society, national and international activities, etc.To repudiate this kind of stigmatization that seriously affect the human rights of Trans people (transvestites, transgenders and transsexuals), and we become the object language of a contentious debate, in which our common vulnerability has nothing to do at all.
