Defensoría del Pueblo cita por 2 ocasión al Comunicador Jose Delgado del programa «EN CARNE PROPIA»  para que rinda declaración frente a denuncia que las Organizaciones de Guayaquil presentaron:

EXPEDIENTE Nº 13085-DPG-2012. DEFENSORIA DEL PUEBLO.- DELEGACIÓN DE LA DEFENSORIA DEL PUEBLO EN LA PROVINCIA DEL GUAYAS.- Guayaquil, Febrero 10 del 2012; las 10:22.- En mi calidad de Delegada de la provincia del Guayas del Defensor del Pueblo del Ecuador, avoco conocimiento del petitorio presentado por EC. CARLOS ISAIAS ALVAREZ PACHECO y GONZALO ABARCA, COORDINADOR GENERAL y COORDINADOR SEGUIMIENTO Y MONITOREO DE MEDIOS DEL OBSERVATORIO CIUDADANO GLBTI, respectivamente, en contra del LIC. CARLOS DELGADO, presentador del Programa EN CARNE PROPIA, quien presumiblemente adecuo su conducta en acciones contrarias a los principios y garantías constitucionales, por presuntamente inducir a la discriminación en el programa En Carne Propia, que se presentó el 26 de enero del 2012. Que dichas acciones pueden estar enmarcadas en afectación de derechos humanos fundamentales garantizados por la Constitución de la República del Ecuador relacionados con la no discriminación, derecho a la igualdad formal y no discriminación; principio del ejercicio de la aplicación de derechos que nadie puede ser discriminado por ninguna razón, entre las que se señala la orientación sexual; derechos y garantías relacionados con la integridad personal, a una vida libre de violencia y derechos de libertad. Por reunir los requisitos legales y reglamentarios, de conformidad a lo preceptuado en los artículos 14, 16 y 17 de la Ley Orgánica de la Defensoría del Pueblo, en concordancia con los artículos 11.2, 66.4, 7, 18, 29.d de la Constitución de la República del Ecuador, en concordancia con artículo 58. c de la Ley de Radiodifusión y Televisión, se admite al trámite la queja propuesta, iniciándose la INVESTIGACION SUMARIA E INFORMAL, disponiéndose para el efecto lo siguiente, en base a la facultad que me concede el artículo 215 de la Constitución y artículo 10 de la Ley Orgánica de la Defensoría del Pueblo, se admite al trámite la queja propuesta, por lo que DISPONGO: 1.- Se acogen las gestiones previas realizadas, a través de los oficios remitidos constantes en el expediente. 2.- Atenta a la razón sentada a foja 5, se toma en cuenta la intervención como requirientes dentro del presente expediente a: ING. FERNANDO PINEDA MORÀN, Presidente de Fundación Diverso Ecuador; LIA BURBANO MOSQUERA, Presidenta de M&M; OSCAR UGARTE ORDOÑEZ, Vicepresidente de Fundación Diverso Ecuador; EC. CARLOS ISAIAS ALVAREZ PACHECO, Coordinador General y AB. SILVIA BUENDIA, Asesora Legal del Observatorio Ciudadano GLBTI. 3.- Notifíquese con el presente auto y copia de lo actuado en el proceso al LIC. JOSE DELGADO, PROGRAMA EN CARNE PROPIA, para que se sirva contestar los fundamentos del mismo. 4. Por considerarlo pertinente hágase extensiva la presente investigación a los representantes legales de CANAL UNO, quienes deberán contestar la queja adjunta. 5.- Que los requeridos: LIC. JOSE DELGADO y REPRESENTANTE CANAL UNO, se sirvan hacer llegar copia del video de la transmisión del programa EN CARNE PROPIA del día 26 de Enero del 2012, fecha en que presuntamente se dieron los hechos descritos. Todo lo cual se les concede el plazo de ocho días. 6.- Hágase conocer de la presente investigación al Superintendente de Telecomunicaciones; Consejo Nacional de Radio y Televisión; Consejo Nacional de Telecomunicaciones; Asociación de Canales de Televisión; Ministerio de Justicia y Derechos Humanos; Comité Permanente para la Defensa de los Derechos Humanos; y, todos aquellos que tengan que ver con la presente investigación, para que coadyuven dentro de su competencia. 7.– Sin perjuicio de lo dispuesto, se convoca a todos los señalados a AUDIENCIA para el día LUNES 27 DE FEBRERO DEL 2012, a las 10:30,con el objeto de promover y acordar posibles mecanismos de solución al conflicto planteado. 8.- Deléguese a la Ab. Lourdes Rangel Donoso, para que ejecute lo dispuesto y continúe con las investigaciones pertinentes con todas las facultades concedidas en la Ley. Ombudsman’s appointment for 2 at the Communicator Jose Delgado of the «first hand» that makes a statement against complaint filed Guayaquil Organizations:
